GATIIMAN – Terms and Conditions / Terms of Use

The parties to this agreement are GATIIMAN, THE VENDOR, and THE CUSTOMER (hereinafter referred to as ‘GATIIMAN’, ‘we’, ‘us’, ‘our’, ‘Vendor’, and the Customer as ‘you’, ‘User’).

The domain name/s https://www.gatiiman.com (hereinafter referred to as "Mobile App/Gatiiman/Application/Website") is owned by  GATIIMAN Expert Services, having its registered office at: Main Road, Opposite Janta Bank, Indapur, Pune-413 106.

GATIIMAN serves solely as a directory for its users and provides an exclusive platform for VENDORS and CUSTOMERS for the purposes set out herein, based entirely on the information furnished by the VENDOR, subject to the following terms and conditions.

The VENDOR is a person or entity making their information available on GATIIMAN to market or advertise its products and/or services to Customers. The VENDOR 

The CUSTOMER is a person accessing and/or using the services provided by GATIIMAN via the mobile application or website, including services such as drivers, electric wireman, pest control, plumber services, and RO services. The Customer herein refers to any person with a registered account on GATIIMAN.

By using or accessing the services of GATIIMAN, the Vendor and Customer agree to be bound by all the terms set out below.

1. Governing Act:

1.1) This Terms and Conditions document is an electronic record under the Information Technology Act, 2000 and applicable rules, including amendments pertaining to electronic records. It is computer-generated and does not require physical or digital signatures.

1.2) This document is published per the Information Technology (Intermediaries Guidelines) Rules, 2011, which require publishing the rules, regulations, privacy policy, and Terms of Use for access or usage of https://www.gatiiman.com and the mobile application.

2. Third Party / Intermediary:

2.1) Vendors and Customers acknowledge that GATIIMAN only provides a platform to display Vendor information for Customers. Vendors and Customers acknowledge that GATIIMAN only displays the information which is uploaded and filled-in solely by the VENDOR.

2.2) GATIIMAN acts solely as an intermediary enabling Vendors to register, create profiles, and display their services. GATIIMAN does not provide or guarantee Vendor services directly.

2.3) Vendors must provide accurate information, including operational phone numbers and email addresses.

3. General Conditions:

3.1) Vendors agree to provide lawful services; Customers agree to seek lawful services.

3.2) Vendors and Customers must read, agree, and accept all terms and privacy policies before registration.

3.3) Membership is valid for one year unless renewed.

3.4) Registration requires accurate personal information.

3.5) Vendors and Customers are responsible for account security, including usernames and passwords.

3.6) Use of the platform for illegal or unauthorized purposes is strictly prohibited.

3.7) Multiple Vendor profiles without authorization may be deactivated by GATIIMAN.

3.8) Vendors may only promote services for which they are registered on GATIIMAN.

4. Security Policy:

4.1) GATIIMAN maintains processes to safeguard Vendor and Customer information.

4.2) Bank details and payments are secured via third-party payment gateways.

4.3) Feedback submitted by Vendors or Customers is non-confidential and may be used by GATIIMAN freely.

4.4) Vendors agree that GATIIMAN may process their information to provide suitable services to Customers.

5. Content Policy:

5.1) GATIIMAN does not warrant that Vendor content meets Customer expectations.

5.2) The platform provides only an interface for Vendors to display services.

6. Payment of Fees and Mode of Payment:

6.1) Payments made by Vendors via cash, cheque, card, NEFT, or net banking follow prevailing RBI guidelines.

6.2) Free Trial: New vendors shall be entitled to free trials for accessing GATIIMAN services in accordance with GATIIMAN’s policy. Details regarding the free trials shall be made available on the GATIIMAN app and website.

6.3) Subscription Fees: After the trial, Vendors must pay applicable subscription fees. Failure to pay will result in automatic deactivation of the Vendor’s profile.

6.4) Multi-Service Registration: A Vendor may register to provide multiple services. Subscription fees, if any, apply to each service after the trial period.

6.5) Direct Payment: Payments from Customers for Vendor services are made directly to the Vendor. GATIIMAN is not involved in these transactions.

6.6) Activation of services is subject to payment realization.

6.7) Dishonoured cheques or failed payments incur bank charges; GATIIMAN is not responsible.

6.8) GATIIMAN may deactivate accounts due to payment issues without prior notice.

7. Information Uploaded by Vendors:

7.1) Vendors must provide accurate, complete, and truthful service information.

7.2) GATIIMAN only displays Vendor information ‘as-is’ and is not responsible for its accuracy.

7.3) Vendor registration is complete upon successful registration and payment of applicable fees, post-trial period.

7.4) Automated search results reflect registered Vendor profiles.

7.5) Vendors are responsible for the content of their profiles, including posts and communications with Customers.

8. Responsibility of the Vendor:

8.1) Maintain account security.

8.2) Updates to profiles may affect automated search results.

8.3) Provide accurate service information and photographs.

8.4) GATIIMAN is not responsible for misrepresentation by Vendors.

8.5) Registration is for finding prospective clients only.

8.6) Profile deletion occurs after one year or upon membership expiry if not renewed.

8.7) Discrepancies in Vendor profiles may lead to termination of membership.

9. Intellectual Property Rights:

9.1) GATIIMAN owns all intellectual property, excluding Vendor-uploaded content.

9.2) Vendors shall not infringe GATIIMAN’s intellectual property.

10. Communication with Vendors:

10.1) GATIIMAN may communicate with Vendors and Customers via email, calls, or SMS.

10.2) Vendors consent to receive communications related to new services or activities of GATIIMAN.

11. Chat Between Vendors and Customers:

11.1) GATIIMAN is not responsible for information or language used in Vendor-Customer communications.

12. Star Ratings:

12.1) GATIIMAN shall not be held responsible for any star ratings assigned by CUSTOMERS to VENDORS. Such ratings are displayed solely based on the feedback provided by the respective CUSTOMERS. 

13. Indemnity:

13.1) Vendors and Customers indemnify GATIIMAN for claims, damages, or losses arising from their use of the platform or violation of Terms.

14. Eligibility:

14.1) Vendors and Customers must be at least 18 years old and of sound mind.

15. Indian Currency:

15.1) Online payments follow the payment gateway’s terms and conditions.

16. Renewal Policy:

16.1) Renewal is available one month prior to membership expiry.

16.2) Late renewal may be treated as new membership.

16.3) Membership cannot be put on hold during the active period.

17. Disputes Between Customers and Vendors:

17.1) GATIIMAN is not responsible for disputes between Vendors and Customers.

17.2) Vendors and Customers are solely responsible for their actions and communications.

18. Jurisdiction and Applicable Law:

18.1) All users agree to exclusive territorial jurisdiction of Indapur, Pune, Maharashtra, India.

18.2) Indian law governs all disputes.

19. Content Rights

19.1) All content, excluding Vendor content, belongs to GATIIMAN.

19.2) Vendors retain ownership of their profile content.

19.3) Vendors grant GATIIMAN a worldwide, royalty-free license to use submitted content.

20. Breach:

20.1) GATIIMAN may terminate membership for misuse or misrepresentation.

20.2) Termination provisions in Clause 22 apply.

21. Customer Care:

21.1) Contact details for queries, complaints, or support are provided on the platform.

22. Limited Liability:

22.1) GATIIMAN is not liable for service deficiencies or non-performance or any inability to provide promised services and or any crime committed etc. by the VENDOR.

22.2) GATIIMAN is not responsible for any direct or indirect damages resulting from platform use.

23. Termination:

23.1) GATIIMAN may terminate Vendor membership for non-compliance with Terms without notice.

23.2) Access to services ceases immediately upon termination.

23.3) Termination does not relieve obligations accrued prior to termination.

24. Right to Modify Terms and Conditions:

24.1) GATIIMAN may modify Terms at any time without notice. Users should review Terms regularly.
